Hospital Licensing Rules Codifying Legislation Adopted

Memorandum
The Illinois Dept. of Public Health (IDPH) has adopted amendments to the Hospital Licensing Requirements (77 Ill. Adm. Code 250 et seq.), (Sept. 12, Illinois Register, pages 11475 to 11517). The adopted amendments, which are now effective, codify recent statutory changes made to the Hospital Licensing Act pursuant to P.A. 103-0803 and P.A. 103-0948. Enacted in 2024, P.A. 103-0803 expands the reporting requirements for patient abuse to include a hospital affiliate. P.A. 103-0948 creates a certificate of birth resulting in stillbirth, known as Liam’s Law.
This memo serves as a summary of the adopted changes.
Hospital Affiliates
Section 250.260 – Patients’ Rights has been updated to add “hospital affiliate” to the relevant subsections as it relates to the reporting of abuse by a hospital employee on a patient. Hospital affiliate is defined as “a corporation, partnership, joint venture, limited liability company, or similar organization, other than a hospital, that is devoted primarily to the provision management, or support of healthcare services and that directly or indirectly controls, is controlled by, or is under common control of the hospital.” In addition, the reports submitted to IDPH must also include the date of the alleged abuse incident and the date the hospital or its affiliate was notified, and a description of the alleged abuse.
Liam’s Law
Section 250.1830 – General Requirements for All Obstetric Departments has been updated to set forth the requirements for hospitals to offer and provide a certificate of birth resulting in stillbirth for a spontaneous fetal death occurring during or after at least 20 weeks gestation.
Hospitals are required to utilize the Liam’s Law notification form developed by IDPH, or an equivalent form acceptable to IDPH, that includes information about the mother being able to request a certificate of birth resulting in stillbirth prior to discharge. These notices are to be available in English and Spanish at a minimum. Hospitals are to develop policies to ensure a mother, or support person, receives one paper copy of the certificate prior to discharge and document that provision in the mother’s medical record. Finally, hospital policies should reflect safeguards to prevent the issuance of Liam’s Law notice to patients presenting with pregnancy outcomes other than stillbirths.
