IDPH Adopts Rules on Reinstating Hospital Operations after Suspended Services

MEMORANDUM
The Illinois Dept. of Public Health’s (IDPH) adopted amendments to the Hospital Licensing Requirements (77 Ill. Adm. Code 250 et seq.), (Nov. 28 Illinois Register, pages 18995 to 19012). These adopted changes sought to alleviate gray areas within the regulation on what steps hospitals must take to reinstate suspended operations that resulted from violations of the Hospital Licensing Act, its corresponding rules, or termination by the Centers for Medicare and Medicaid Services (CMS). This includes submission of a plan of correction and an updated license application. The rules further outline steps IDPH will take to ensure compliance, including an initial and follow-up survey.
Additionally, the adopted rules further clarify what information a hospital must provide to the Department as part of a permanent hospital closure notification. This includes the address (physical location) of all medical records and medical staff credentialing files and a contact name, phone number, and email address for the keeper of the medical records.
These adopted rules are effective as of Nov. 10.
